A Hard Bargain: Treatment of Medical Special Damages for Medicare and Medicaid Beneficiaries
Since Swanson v. Brewster resolved the issue of awards for discounted medical services for plaintiffs with private insurance under Minnesota’s Collateral Source Statute, we still discuss the issue for those plaintiffs with large discounts provided by Medicare and Medicaid due to their exemption from the statute. We will discuss this issue from two perspectives.
