House Legislation Will Give Public Access to Life Saving Information
(Washington, DC) AAJ — Companies would be compelled to disclose product defects, under legislation introduced today. The Sunshine in Litigation Act, introduced by U.S. Rep. Robert Wexler (D-FL) and U.S. Rep. Jerrold Nadler (D-NY), would make settling law suits with secrecy agreements more difficult; ensuring that life saving information is not kept hidden.

Minnesota's new first party good faith law |

On Friday, April 18, 2008, the Governor signed into law S.F. 2822,
creating Minnesota's new first party good faith law, § 604.18, which will be
"effective August 1, 2008, and applies to causes of action for conduct that
occurs on or after that date." The bill is available online on the Minnesota State Office of Revisor of Statutes Website, and MNAJ plans an informative seminar shortly to go over the standards of
proof and remedies available under the new law and practice tips on how to
employ it to assist consumers with their first party insurance claims.

Latest Medtronic Device Failure Highlights Dangers of Preemption |

(Washington, DC) AAJ – A new Food and Drug Administration (FDA) public health notification shows a higher death rate after five years among patients treated for abdominal aortic aneurysm with Medtronic Inc.’s Aneu-Rx stent-graft system than among those treated through conventional surgery.
The recent U.S. Supreme Court ruling in Riegel v. Medtronic, Inc. limited the rights of people to receive justice through the legal system when harmed by medical devices such as Aneu-Rx.

AAJ URGES FDA TO PUT PATIENT SAFETY FIRST - Agency continues to defy Congressional intent |

(Washington, DC) AAJ
- The American Association for Justice today sent comments to the Food and Drug
Administration (FDA) concerning a proposed rule that would give immunity to drug
companies for failing to warn patients of potential drug
hazards.
This rule directly contradicts Congressional intent that drug
manufacturers have a duty to warn the public about potential problems when they
become aware of drug risks.
"This proposed FDA rule is a giant step backward for patient
safety," said AAJ President Kathleen Flynn Peterson. "Not only will it keep patients in the dark
about the safety of their prescriptions, but will also shield companies from
being held accountable for their negligence."

MNAJ Donates Freezer to Avenues |
|

Pictured to the left is a photo of the freezer so generously purchased by MNAJ members for Avenues for Homeless Youth. They are thrilled with the more than doubling in size of the prior freezer, and have been able to accept additional food donations because they now can freeze them. Their menus have also benefitted!
The Women's and New Lawyer's groups are going put together 20 holiday
bags for the youth at Avenues. Depending on donations received, they
will include gift cards, bus cards and some personal items. If you
